By subscribing to our services, you are agreeing to comply with and be bound by the following terms and conditions:
1. Limited Subscription Pause
You can pause your subscription once per cycle for up to twelve months. Should you not reactivate your subscription within this period, any leftover subscription time will be lost. Additionally, we cannot assure that the same team will be accessible upon your return, as they may be allocated to different projects. The timing for reinstating your paused subscription will also be subject to our availability.
2. Non-Refundable Policy:
Please note that all services rendered by Esfera Design LTDA are non-refundable. The decision to continue using our services after experiencing our work is entirely up to you, the client.
3. Service Termination on Non-Renewal:
Esfera Design LTDA reserves the right to cease any ongoing work immediately if your subscription is not renewed at the end of your 30-day billing cycle. It is your responsibility to avoid any service interruptions by ensuring timely subscription renewal.
4. Service Availability:
Our services will not be available during Brazilian national holidays and during a designated one-week recess at year's end. While there are no discounts for these non-service periods, you may choose to pause your subscription at anytime during the year.
5. Intellectual Property Rights and Access:
After making your subscription payment, you acquire intellectual property rights to all materials produced by Esfera Design LTDA. While we will keep your Figma files available for as long as possible, it is crucial for you to copy or duplicate any essential materials during this time. Please note, we may limit access to these files without previous warning 30 days following the conclusion of your subscription.
6. Exemption in Force Majeure Events:
Esfera Design LTDA will not be responsible for failing to provide services in the event of force majeure, which includes, but is not limited to, scenarios such as death, bankruptcy, and other uncontrollable circumstances.
7. Defined Scope of Services:
During the subscription period, we will provide only the services specified in the pricing section of our website. This excludes services such as animations, video productions, illustrations, or any other offerings not explicitly mentioned.
8. Client Confidentiality:
We are committed to maintaining the confidentiality of our client relationships unless you permit us to use your projects and branding in our marketing materials.
9. Informed Collaboration:
By subscribing, you affirm that you have previously experienced our services and have chosen to collaborate with Esfera Design LTDA voluntarily and with full knowledge of our service quality and communication standards.
10. Trial period policy:
Esfera reserves the right to suspend or terminate the trial at any time, should we determine that the partnership is unlikely to be successful. Furthermore, all designs produced by Esfera throughout the trial period shall remain the property of Esfera, with their usage and distribution at Esfera's sole discretion.
11. Weekly meetings and Live sessions
Esfera will provide access to the design team for meetings and live design sessions, with certain limitations. We can commit to no more than two meetings per week and no more than two hours of live session time weekly. For ongoing communication and design feedback, we encourage the use of text channels and Figma comments throughout the duration of your subscription.
Please review these terms regularly, as continued use of our services after any updates signifies your agreement to those changes. These terms constitute the full agreement between you and Esfera Design LTDA regarding your use of our services.
